Rubbish Removal Elephant and Castle Terms and Conditions

These Terms and Conditions set out the basis on which we provide rubbish removal and waste collection services. By making a booking, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for any service.

1. Definitions and Interpretation

In these Terms and Conditions, the following definitions apply:

1.1 Service means any rubbish removal, waste collection, waste clearance, loading, transportation or related service that we provide to you.

1.2 We, us and our mean the service provider operating under the name Rubbish Removal Elephant and Castle.

1.3 You and your mean the customer or client who requests and uses our services, whether acting as an individual, business, landlord, agent or other legal entity.

1.4 Premises means the property, building, land or area from which the waste is to be collected or in which the service is to be carried out.

1.5 Waste means the items, materials, rubbish or refuse that you ask us to collect and remove, subject to applicable waste regulations and any exclusions set out in these Terms and Conditions.

1.6 Contract means the agreement between you and us for the supply of services, comprising these Terms and Conditions and the details confirmed in your booking.

2. Scope of Services

2.1 We provide rubbish removal and waste collection services, including loading waste from your premises, transporting it, and arranging for lawful disposal or recycling.

2.2 We reserve the right to refuse to collect any items that we reasonably believe to be hazardous, illegal, excessively heavy, unsafe to handle, or not in compliance with relevant waste disposal laws or our licence conditions.

2.3 Our services are provided for domestic, commercial and landlord customers. Different pricing and conditions may apply depending on the type and volume of waste, the access to the premises, and any additional labour required.

2.4 We will carry out the services with reasonable care and skill and in accordance with applicable environmental and waste management regulations in the United Kingdom.

3. Booking Process

3.1 You may request a booking for rubbish removal by contacting us via telephone, email or any booking form we may provide. You must provide accurate information about the type, approximate volume and location of the waste, and any access or parking restrictions at the premises.

3.2 Any quotation provided before our arrival is based on the information you supply. If, on arrival, the waste is materially different in type or volume from that described, or if access is significantly more difficult than indicated, we may amend the quotation and agree a revised price with you before commencing work.

3.3 A booking is deemed accepted, and a contract formed, when we confirm the date, time window, and estimated price of the service, whether in writing or verbally. We reserve the right to refuse any booking at our discretion.

3.4 You are responsible for ensuring that someone with authority to authorise the work and payment is present at the premises at the agreed time. If no such person is present, we may not be able to complete the service and cancellation or waiting charges may apply.

4. Access, Parking and Site Conditions

4.1 You must ensure suitable access to the premises so that our team can safely load and remove the waste. This includes ensuring that driveways, entrances, stairways, lifts and passageways are clear and safe to use.

4.2 You must inform us in advance of any parking restrictions, loading bays, time limits, congestion charges or other restrictions that might affect our ability to carry out the service. You are responsible for any parking permits or access permissions required for the service.

4.3 Any parking charges or fines incurred as a direct result of inadequate information or instructions provided by you may be added to your final invoice.

4.4 We reserve the right to refuse to carry heavy or bulky items through areas that we consider unsafe or where there is a significant risk of damage to property or injury to persons.

5. Pricing and Payments

5.1 Prices are generally based on the volume and type of waste removed, measured by the amount of space your waste occupies in our vehicle or by another agreed method. Additional charges may apply for heavy or special waste, difficult access, or extra labour time.

5.2 All prices will be confirmed with you before any waste is loaded, following inspection of the waste on site. If you do not agree to the final price, you may cancel the service at that point without charge, provided no work has commenced.

5.3 Unless otherwise agreed in writing, payment is due immediately upon completion of the service. We accept payment by cash, credit or debit card, bank transfer or any method we notify to you in advance.

5.4 For business customers, we may, at our discretion, agree account or invoice terms. In such cases, invoices must be paid within the specified period stated on the invoice. We reserve the right to charge interest on late payments at the statutory rate, as well as reasonable administration and recovery costs.

5.5 All prices are quoted inclusive or exclusive of VAT as specified at the time of quoting. If applicable, VAT will be added at the prevailing rate in accordance with UK law.

6. Cancellations, Amendments and Waiting Time

6.1 You may cancel or amend your booking by giving us as much notice as possible. For standard bookings, cancellations made more than 24 hours before the scheduled arrival time will normally not incur a charge.

6.2 We reserve the right to charge a cancellation fee if you cancel within 24 hours of the scheduled arrival time, if our team arrives at the premises and is unable to gain access, or if you choose not to proceed once the team is on site and ready to begin work.

6.3 If we are delayed at the premises due to circumstances within your control, such as lack of access, incomplete preparation of waste, or waiting for authorisation, we may charge a waiting time fee after a reasonable grace period.

6.4 We may cancel or reschedule the service if affected by events beyond our reasonable control, including severe weather, accidents, vehicle breakdowns, staff illness, or unexpected road closures. In such cases, we will notify you as soon as reasonably practicable and offer an alternative time. We will not be liable for any loss arising from such cancellations or delays, but you will not be charged for services not carried out.

7. Customer Responsibilities

7.1 You are responsible for ensuring that the waste to be collected is your property or that you have the full authority of the owner to arrange its removal.

7.2 You must clearly identify the waste to be removed and ensure that no items are removed by mistake. We are not responsible for items taken in good faith where they have been presented in a way that reasonably indicates they are to be disposed of.

7.3 You must remove or make safe any personal or sensitive data from items to be collected, such as paperwork, computer equipment or storage media. We accept no responsibility for the security or confidentiality of data contained within items removed as waste.

7.4 You must not present for collection any waste that is hazardous, explosive, radioactive, or otherwise prohibited by law. If you present such waste without declaring it, you will be responsible for any resulting losses, costs, fines or claims incurred by us.

8. Waste Regulations and Environmental Compliance

8.1 We operate in accordance with relevant UK waste management and environmental legislation and aim to promote recycling and responsible disposal wherever possible.

8.2 All waste collected will be transported to licensed and approved facilities for recovery, recycling, treatment or disposal, in line with current regulations and best practice.

8.3 We may issue a waste transfer note or similar documentation when required by law or on request for commercial collections. You must retain any such documentation as part of your own legal obligations under waste duty of care regulations.

8.4 We reserve the right to refuse certain categories of waste, including but not limited to asbestos, medical or clinical waste, chemicals, oils, fuels, pressurised containers, and any waste classed as hazardous under applicable regulations, unless we have expressly agreed in writing and are suitably licensed and equipped to handle such material.

9. Liability and Limitations

9.1 We will exercise reasonable care when carrying out the service. However, you acknowledge that the nature of rubbish removal and waste collection work may pose a risk of minor damage, especially in tight access areas or when moving bulky items.

9.2 We will not be liable for any pre-existing damage to property, fixtures, fittings or surfaces, or for wear and tear that becomes apparent during or after the service.

9.3 Our liability for damage to your property caused by our negligence shall be limited to the reasonable cost of repair or replacement, subject to evidence of the damage and its value.

9.4 We will not be liable for any indirect, consequential or economic loss, including loss of profit, business interruption, or loss of opportunity, arising out of or in connection with the provision of the services.

9.5 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be limited or excluded under UK law.

10. Insurance

10.1 We maintain public liability insurance and, where applicable, employer's liability insurance to cover our activities as a rubbish removal and waste collection service provider.

10.2 Details of our insurance cover are available on request. Our insurance is subject to the usual terms, conditions, exceptions and limits of the relevant policy.

11. Complaints and Dispute Resolution

11.1 If you are dissatisfied with any aspect of our service, you should notify us as soon as possible, providing full details of the issue and any supporting information.

11.2 We will investigate your complaint and aim to respond within a reasonable timeframe. Where appropriate, we may offer a remedy such as a partial refund, a re-visit or an alternative solution, at our discretion.

11.3 If a dispute arises that cannot be resolved through our internal process, you and we agree to attempt to resolve it through good faith discussions before considering formal legal action.

12. Data Protection and Privacy

12.1 We will collect and process personal data about you only as necessary to manage bookings, carry out the services, process payments and handle customer relations.

12.2 We will handle your personal data in accordance with applicable UK data protection laws. We will not sell your personal data to third parties and will only share it where necessary for the performance of the contract, to comply with legal obligations, or with your consent.

13. Variations to Terms

13.1 We may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to your contract.

13.2 Any changes to the scope of services, pricing or other key terms that are specific to your booking will be confirmed with you at the time of booking and will take precedence in the event of any conflict with these general Terms and Conditions.

14. Severability

14.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, such provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions and any contract between you and us for the provision of services shall be governed by and construed in accordance with the laws of England and Wales.

15.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute, claim or matter arising out of or in connection with these Terms and Conditions or the services provided.

By confirming a booking with Rubbish Removal Elephant and Castle, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.
